Charges against a Cherokee County man have now been upgraded to murder after new evidence in the case has been discovered. As we previously reported, Nicholas Skyler Lucas was arrested for Involuntray Manslaughter following the shooting death of his neighbor 42 year old Kesha Tate, Saturday afternoon.

Lucas originally told investigators he was shooting for target practice in his yard and the bullet ricocheted hitting Tate, causing fatal injuries. On Tuesday, forensic evidence determined that the bullet did not ricochet and hit Tate.
A statement from the Cherokee County Sheriff's Office says, the only way the victim could have been hit was for the shooter to turn and deliberately fire in that direction. Lucas is being held without bond on the newly upgraded murder charge.
