Fatal deputy involved shooting in WNC ruled justified

A fatal deputy involved shooting in Western North Carolina has been ruled justified.

In July, the Transylvania County Sheriff's Office responded to a call from a woman saying her ex-boyfriend Raul Alberto Rivera was traveling through Pisgah National Forest, armed with a gun and she believed he intended to harm himself.

Deputies then found a vehicle matching the description of Rivera's vehicle. The District Attorney's Office says when deputies approached the vehicle, Rivera raised a gun and gunfire was exchanged.

Rivera reportedly refused to put his gun down and deputies continued firing. Eventually Rivera was found unresponsive in his vehicle and an AR-15 was found inside. He was pronounced dead at the scene.

The DA's office has ruled that the use of lethal force by the deputies was justified and there will be no charges filed.
