A federal court has found that South Carolina's age based absentee voting system is a violation of the constitution. The Fourth Circuit Court Of Appeals has rendered a 30 page legal opinion
. The ruling says, the state can't allow voters 65 and older to cast a no-excuse absentee ballot while at the same time requiring most younger voters to qualify for the same voting method. The lawsuit was originally filed in 2023. Federal judge Roger Gregory found that the statute is a violation of the 26th Amendment.
The lawsuit was filed by five voters from South Carolina voters who are younger than 65, they claim the current absentee voting law discriminates against them based on their age.
The appeals court has given the state two possible options, either extend no excuse absentee voting to those under 65 or eliminate no-excuse absentee voting for those 65 and older.
