
A state lawmaker's seven-year fight to legalize medical marijuana in South Carolina appears to be over. Despite Senate support, the legislation met sudden death in the House. Senator Tom Davis thought he had a ten-vote margin for House passage of his bill to allow prescription use of marijuana for a strict list of medical conditions, including cancer and glaucoma. But the Beaufort Republican watched in stunned disbelief from back of the House Chamber late Wednesday as opponents of the legislation asked House Speaker Pro Tem Tommy Pope to declare the bill out of order saying its six percent fee on sales of medical marijuana to cover regulatory enforcement costs amounts to a tax. The state constitution says tax legislation can only originate in the House. So Pope ruled accordingly and House members voted 59-to-55 in favor of the Speaker's decision.
