A North Carolina appeals court has ruled that a law stripping the governor’s authority to appoint State Board of Elections members can take effect for now. Wednesday’s decision came a week after trial judges struck the law down as unconstitutional.
If left intact, the decision means provisions slated to take effect Thursday would shift appointment duties from Democratic Gov. Josh Stein to GOP State Auditor Dave Boliek, at least temporarily.
Stein’s attorneys asked the state Supreme Court later Wednesday to halt the Court of Appeals order temporarily.
A panel of trial judges agreed with Stein last week that the appointment changes unlawfully took powers away from the governor.
