SAN FRANCISCO (KCBS RADIO) – California Attorney General Rob Bonta will review the fatal shooting of Banko Brown following San Francisco DA Brooke Jenkins' decision not to pursue charges.

The AG's Office confirmed it's taking up the review in a statement to KCBS Radio. Bonta will decide if Jenkins' resolution not to file murder charges against the Walgreens security guard who shot Brown was an abuse of discretion.

"It means that at least there is another group of lawyers who will look at this and they're not obligated and they don't have to just accept what this local DA has done," said American civil rights attorney John Burris, who is representing Brown's family.

Bonta's office could file charges of its own, which Burris believes would be warranted.

"Banko was unarmed, was backing away, he was outside of the store, the officer was inside of the store and so his life could not have been in danger," Burris said.

DA Jenkins welcomes Bonta's review. She argued there wasn't a case to be brought for the altercation over alleged shoplifting. "We had to decide whether or not we had sufficient evidence to prove this case to 12 jurors beyond a reasonable doubt," she stated. "It was our conclusion that we did not have such evidence."

Brown's family has been pushing for an outside perspective since Jenkins announced she would not be filing charges. They are grateful for the second opinion. A funeral for Brown will be held on Thursday, May 24, in San Francisco.
