Bay Area prosecutors do not charge Mike Tyson in viral SFO altercation

SAN FRANCISCO (KCBS RADIO) – Bay Area prosecutors will not charge Mike Tyson after last month's viral altercation with a fellow passenger aboard a flight leaving San Francisco International Airport.

San Mateo County District Attorney Steve Wagstaffe said his office completed its review on Monday afternoon, deciding not to file misdemeanor battery charges against Tyson "based on the circumstances surrounding the confrontation."

"These include the conduct of the victim leading up to the incident, the interaction between Mr. Tyson and the victim, as well as the requests of both the victim and Mr. Tyson that no charges be filed in this case," Wagstaffe announced on Tuesday morning.

Tyson, in San Francisco for the annual April 20 "Hippie Hill" event in Golden Gate Park, was shown on cell phone video obtained by TMZ repeatedly punching a passenger sitting behind him on a JetBlue flight bound for Florida that night.

A source close to the 55-year-old former boxer told the outlet that the passenger was drunk and provoking Tyson, while a witness said Tyson was patient with the passenger before becoming increasingly frustrated.

Wagstaffe said prosecutors reviewed police reports from the San Francisco Police Department and San Mateo County Sheriff's Office, as well as the videos recorded by other passengers.

The San Francisco Police Department told KCBS Radio last month that it had detained two people "believed to be involved in the incident," and the one who had sustained minor injuries "provided minimal details of the incident and refused to cooperate further with the police investigation."
