Sacramento County District Attorney Marie Schubert said in a press conference on Tuesday that Smiley Martin, Dandrae Martin and Mtula Payton had been charged with murder following the April 3 shooting in which six people died and 12 others were injured. The trio also face weapons charges, according to Schubert.
Officials have alleged that five people fired shots during an alleged confrontation between two rival gangs, the Garden Blocc Crips and Bloods-affiliated G Mobb.
Brothers Smiley and Dandrae Martin are allegedly members of the 29th Street Crips and Garden Blocc Crips, according to court documents obtained by The Associated Press, while Payton is allegedly a member of G-Mobb.
Prosecutors charged the trio with the murders of Johntaya Alexander, Yamile Martinez-Andrade and Melinda Davis, whom officials allege were killed after leaving nearby bars and nightclubs during the shootout.
They were not charged in the deaths of Devazia Turner, Sergio Harris and Joshua Hoye-Lucchesi, three alleged gang members who were killed that night.
The Martins, Payton and Turner all opened fire during the confrontation, according to officials, as did at least one other person. Neither police nor prosecutors have identified the alleged additional shooters.
Turner allegedly fired multiple shots at the Martins. Chief Deputy District Attorney Ron Norgaard told reporters on Tuesday that it is "very difficult to charge" someone for killing a person if the victim participated in the crime.
