PITTSBURGH (Newsradio 1020 KDKA) – Michael Rosfeld, the former East Pittsburgh police officer who was acquitted in the shooting death of Antwon Rose II, is suing the University of Pittsburgh.
According to the Pittsburgh Post-Gazette, Rosfeld is suing the university, its police chief and a top official, stating that Pitt improperly fired him from the school’s police force.
Rosfeld was fired after he arrested three men outside an Oakland bar in 2017. One of the men arrested was Daniel Humphrey, the son of Senior Vice Chancellor Kathy W. Humphrey.
Rosfeld states that Pitt violated his due process rights and the 14th amendment when he was fired after the incident without an internal hearing.
The suit claims that Rosfeld was placed on administrative leave after the incident at the Garage Door Saloon, and six weeks later, was given a memo during a meeting stating that he had been terminated.
Rosfeld says he was never given an explanation as to why he was terminated, nor was he given the “pre-termination due process meeting,” the Pittsburgh Post-Gazette reports. This specific meeting, called a Loudermill hearing, would have given Rosfeld a chance to present evidence and contest his firing.
Rosfeld is asking for a Loudermill hearing, to be reinstated as a Pitt police officer, and given lost wages and benefits since 2018.
