Attorneys for the man accused of gunning down 11 people at a Squirrel Hill synagogue in 2018 are trying to have the charges against him dismissed.

The defense is asking for a hearing on the issue. The judge yet to rule on the motion.

A motion was filed by the defense saying the federal court jury system in Pittsburgh underrepresents the minority population.

They say the pool of 85 grand jurors in Robert Bowers' case included only one Black person, who was excused.

A Tribune-Review story says the defense has provided research showing capital punishment is imposed in 72% of cases with no Black men on a jury.

That number drops to 43% when there is at least one. The US Attorney's office says Blacks and Hispanics in the jury pool fail to receive and return juror questionnaires at the same rate as whites.
