The Blackhawk School District has filed a lawsuit against Norfolk Southern over last month's train derailment in East Palestine, Ohio
The suit filed Thursday in federal court contends Blackhawk students and staff have rashes, eye irritation and respiratory problems caused by hazardous materials spilled in the accident and toxins from the controlled burn of vinyl chloride.
Attorney Tom King represents the school district and talked about the suit on the Big K Morning Show.
“What we’re asking for it monitoring, medical monitoring,” said King. “We’re asking for them to come in and do appropriate testing and these are things that should not be paid for by the taxpayers of the Blackhawk School District, they ought to be paid for by Norkfolk Southern.
The district's suit also alleges contamination of its property, soil and water and cites an increased risk of future disease.
During a public hearing last week with members of the PA House of Representatives in Darlington, Beaver County, the head of the Pennsylvania Department of Environmental protection said that testing of water, soil and air continues to show to concerning levels of pollution.
