
A jury is deliberating if convicted Tree of Life Synagogue shooter Robert Bowers is eligible for the death penalty.
Closing arguments in the penalty phase took place Wednesday afternoon. The jury received the case around 3 p.m.
For the last two weeks, the prosecution has argued Bowers planned his attack on worshippers on October 27, 2018. Meanwhile, the defense tried to convince the jury Bowers has mental health issues making him incapable of premeditation.
For Bowers to be eligible for the death penalty, prosecutors would have to prove that Bowers is at least 18-years-old, that he acted with intent and that there is at least one aggravating factor.
The jury will begin deliberations following closing arguments to decide if the death penalty should remain on the table. Defense attorney Marty Dietz told the Big K Morning Show, all jurors must agree for the death penalty to remain a possibility.
"The defense is going to beg for his life," he said. "They're going to try to appeal to one juror, just one juror and hope like hell that juror votes for life."
If the decision is not unanimous, Bowers will automatically be sentenced to life in prison.
