Charges against 38-year-old Bruno Guedes da Silva have now been withdrawn.
He was taken into custody for allegedly trying to buy a glock and saying he was not an illegal alien in the US on the paperwork.
ICE said he is in the country illegally, but his attorney says he's seeking asylum.
The Trib says the DA's office withdrew charges against him Wednesday, citing compassionate and humanitarian reasons.
Da Silva's daughter is receiving cancer care at a local hospital.
Federal authorities still have da Silva in custody.
He faces a bond hearing on the April 13.
