
A producer has dropped his lawsuit against Dr. Dre in which the plaintiff maintained the Aftermath Entertainment founder used his song without permission or compensation.
An attorney for plaintiff Micah Foster filed court papers on Monday with Los Angeles Superior Court Judge Cherol J. Nellon asking that her client's case be dismissed "without prejudice," meaning it cannot be refiled later. The court papers do no state if a settlement was reached or if Foster is not pursuing the case for other reason.
According to the breach of good faith/unjust enrichment suit originally filed in May 2023 and amended on Dec. 26 to include Interscope Records and Universal Music Group Inc, Foster created a track on SoundCloud in 2013 called "The Don Big Boss Whistle 2013."
Foster alleges Dre listened to his beat and song track on SoundCloud and used it in a mix for a Kendrick Lamar song, "The Heart Part 5," without getting consent from the plaintiff or paying him. Foster also is suing Aftermath, Interscope Records and Universal Music Group Inc.
Attorneys for Interscope and UMG denied Foster's allegations and said they fell under the federal Copyright Act.
