FLORISSANT, Mo (KMOX) - Two Florissant Police officers who were with, former Detective Joshua Smith, when the SUV he was driving struck a fleeing suspect, will not face any charges. Special Prosecutor Tim Lohmar says the officers have been cleared of any wrongdoing.

They had been suspended pending an investigation.

The two detectives were inside an unmarked police SUV when Smith, who was driving, allegedly struck the man with the vehicle and then kicked and hit the suspect when he was on the ground. There's video of the incident.

Protesters have been out in front of the Florissant Police Department every night, calling for those to be fired. Florissant Police Chief Tim Fagan told KMOX, both of those officers were not part of the incident.

They had jumped out of the SUV and were involved in another situation, not part of the arrest.

Smith was charged last week with two counts of assault, and one count of armed criminal action. He was terminated earlier this month before charges were filed.
