Judge rules McCloskey does not get guns back

ST. LOUIS (KMOX) - No luck for St. Louis lawyer Mark McCloskey and his wife after trying to reclaim firearms they previously agreed to surrender in 2021.

Judge James Dowd from the Missouri Court of Appeals ruled Wednesday that because McCloskey pleaded guilty instead of arguing he was acting in self defense, he waived his ability to reclaim the firearms. The McCloskey's gave up the two firearms when he pleaded guilty to a fourth degree misdemeanor in exchange for the state dismissing a felony charge.

McCloskey -- who famously stood outside his home alongside his wife Patricia and pointed firearms at protestors back in 2020 -- asked the Missouri Court to return the AR-15 and pistol from that famous photo taken outside the their home.

A St. Louis judge also ruled in December 2022 that he won't be able to get his guns back, with the judge ruling the pardon had no bearing on the plea agreement.
