A brief hearing held Monday afternoon in St. Louis County Court set Friday May 10th at 9 am as the date of the certification hearing. This comes after an after school fight between the defendant and 16-year-old Kaylee Gain in which the defendant is seen in a viral video slamming Gains head into the ground multiple times. Gain was left hospitalized for days after the fight after suffering a fractured skull.
In Monday's hearing, the juvenile court requested 30 extra days to obtain information for the Pre-Disposition Investigation report which cover's the juvenile defendant's background. The defense agreed to the extension.
May's certification hearing is not a determination of guilt or innocence and only decides if the defendant should be charged as an adult.
Some of the factors considered when determining if the juvenile defendant should be tried as an adult are the seriousness of the offense and the viciousness, force or violence of the accusation.
The hearing is mandatory based on the assault charges against the defendant.
