ST. LOUIS (KMOX) - Missouri Attorney General Andrew Bailey is suing St. Louis County over who has the authority to appoint their next prosecuting attorney.
In their lawsuit, they argue state law supersedes the county charter, saying state law allows the governor to name Bell's replacement, despite the County Charter giving that power to the County Executive.
They are asking for a temporary restraining order to block County Executive Sam Page from naming a replacement to Bell.
Page told KMOX on Tuesday he is done conducting interview and intends to name a successor in early December.
Current Prosecuting Attorney Wesley Bell is leaving the position in January after being elected Congressman.
Bell says he hopes both the County and State can resolve this soon so he can help the incoming Prosecuting Attorney transition into the role before he leaves for Washington.
