Recreational pot will officially be on November ballot after a lawsuit has been thrown out

Legal marijuana is officially on the ballot in November.

A woman named Joy Sweeney was suing to get the measure taken off the November ballot, saying the Secretary of State's re-check of petition signatures was unusual.


A Cole County judge threw out Sweeney's case last week because Sweeney could not prove she was a Missouri resident.

The Missouri Western District Court of Appeals in Kansas City agreed with the Cole County ruling, adn said state law does not "prohibit the Secretary from independently validating the registered voter status of signers whose signatures have been struck through or crossed out on petition pages by local election authorities."

Republican Secretary of State Jay Ashcroft said regardless of how he personally feels about a ballot measure, his oath is to uphold the law.

If the measure passes, Missouri will be the 20th state to legalize recreational marijuana. Voters passed the legalization of medical marijuana in the 2018 election with 65% of the vote, and a recent poll showed that 62% of Missourians support legalizing recreational weed.
