Governor Laura Kelly is moving to defend a Kansas tuition law that helps undocumented students. after the federal government sued to overturn it.
Wednesday morning, the U.S. Department of Justice filed a lawsuit challenging the state law that lets students without legal immigration status pay in–state tuition at public colleges and universities; the DOJ said the law unconstitutionally discriminates against U.S. citizens.
Soon after, Kansas Attorney General Kris Kobach filed a joint motion with the justice department — agreeing to a judgment that would block the law permanently.
The proposed consent decree, which still needs court approval, would bar Kansas from enforcing laws that require public colleges to offer in-state rates to all non-citizens who live in the state, regardless of immigration status.
