
The Fulton County District Attorney, who has been leading an investigation into efforts to overturn the 2020 election results in the state, is expected to bring charges against more than a dozen defendants, including former President Donald Trump.
According to two people briefed on the matter who spoke with The Guardian, the district attorney, Fani Willis, was looking to present evidence to a grand jury early this week. If they indict Trump, the judge has ruled that cameras will be allowed to carry the proceedings live on television.
Willis had summoned former Georgia lieutenant governor Geoff Duncan and reporter George Chidi to testify on Tuesday, a sign that charges could be coming soon.
According to the sources cited in the report, prosecutors have been working for weeks to identify the statutes Trump and others may have violated in the Georgia state criminal code, including a racketeering charge, election law crimes, and other non-election law crimes.
The election law charges that prosecutors were considering bringing against Trump included criminal solicitation to commit election fraud through seeking a public or political officer to fail to perform duties and seeking to destroy, deface or delay the delivery of ballots; and conspiracy to commit election fraud.
Prosecutors have also shown interest in the Rico statute, which, for Trump’s case, would only require prosecutors to show Trump had an “interrelated pattern of activity by and through the [public] office” predicated on a minimum of at least two “qualifying” or predicate crimes from a list of specific statutes.
Earlier this summer, The Guardian also reported that prosecutors have developed evidence of a pattern of racketeering activity that could see Trump hit with a Rico charge based on his influencing of witnesses and computer trespass.
Trump has not held back online when discussing the recent case, saying that Willis, a Black woman, was “racist.” He also alleged that she treated gang members with “kid gloves.”
He also posted this weekend that Democrats were costing him “vast amounts of money” in legal fees because of the politically charged prosecutions.
“The Lunatic Left, working closely with Crooked Joe Biden and his corrupt DOJ, is not only focusing on Election Interference but on getting the Trump Campaign to spend vast amounts of money on legal fees, thereby having less to spend on ads showing that Crooked Joe is the WORST PRESIDENT IN U.S. HISTORY!” Trump said in his post.
Trump is currently facing federal charges in Washington, D.C., and Florida for his alleged mishandling of classified materials and his efforts to overturn the 2020 election results. He is also facing a third indictment in Manhattan over an alleged hush money payment he made in 2016.
