A hearing will be held on Friday in Van Nuys for the Menendez brothers, where the judge is expected to hear arguments from District Attorney Nathan Hochman, who wants to withdraw the resentencing motion.

In October 2024, then-District Attorney George Gascón filed the motion for resentencing for Erik and Lyle Menendez, who were who were convicted in 1996 for their parents’ 1989 murder and sentenced to life in prison without parole. The brothers claimed self-defense and that their father had abused them.

The following month, Gascón was defeated in the race for D.A.

Hochman said he’s reviewed the case and thinks the brothers should stay in prison until they come clean.

“If it is presented with these new insights, unequivocal, sincere acknowledgments of all the lies they have told for the past over 30 years, we too in the district attorney's office will reconsider whether or not we would want to go forward with a resentencing motion,” he said. “But not at this point.”

Friday’s hearing will start at 10 a.m., but between 7:30 a.m. and 8:30 a.m., members of the public can get a lottery ticket for one of the 16 seats inside the courtroom. The drawing for those seats will be at 8:45 a.m.
