The city of San Bernardino will pay $4.9 million to the family of a man shot and killed by police in 2023.
Robert Brown was fatally shot during a foot chase after being pulled over for a traffic violation in December 2023. San Bernardino police claim he was armed with a stolen handgun, but Brown’s family insists body camera footage shows he was unarmed.
“There was no weapon that I was able to find that was there anywhere near where the officer claimed that he saw a gun,” attorney Brad Gage said. “I looked at that video a lot. I did not see a gun. I saw a man using two hands to climb a fence. You can't use two hands that you can see on a fence if you're holding a gun.”
The lawsuit included allegations of civil rights violations, including illegal search and seizure, Gage said.
Brown’s sister Victoria Brown said the lawsuit was about accountability and truth.
“We watched my brother be slandered and demonized for months,” she said. “I had to watch the video for his mother, his murder, so many times. His final moments were alone, scared, and handcuffed. That isn't right.”

Victoria said the money will support her brother's young son.
