
According to WKBW TV, police showed up around 1 a.m. and told protesters to leave or face arrest.
The police department said on Wednesday they arrested 13 people who refused the order. Those people were all charged with obstruction of government administration, being in a park after 10 p.m., and sleeping in a park.
The 13 people were all given appearance tickets.
Protesters have been occupying Niagara Square since June 12. They have been calling for the release of 30 year old Deyanna Davis of Buffalo. Davis is charged with five felonies, including aggravated assault on a police officer after she drove her SUV through a police line on Bailey Avenue June 1, injuring a New York State Police Trooper and two other police officers.
Davis, herself, suffered two gunshot wounds in the chaos.
The protesters argue that Davis should be recovering from her injuries at home, not at the Erie County Holding Center.
Davis is being held on $200,000 bail.
