
SAN JOSE, Calif. (KCBS) — A man who was shot by San Jose police at La Victoria Taqueria Sunday morning had reportedly disarmed the actual gunman to diffuse a fight inside the restaurant, The Mercury News reported.
According to sources familiar with the investigation, the man was backing out of the front door of La Victoria Taqueria with the weapon he confiscated from the gunman when he was confronted by officers and a series of gunshots, the newspaper said.

The man was initially described in police statements posted to Twitter as a "suspect" who was "pointing a handgun at another involved subject." However, other sources said he was actually trying to prevent a fight at La Victoria Taqueria from becoming deadly.
He was shot at least once by San Jose police, but his injuries were not life-threatening and he is now recovering at a local hospital.
In a Twitter post, San Jose Police Media Relations said additional details on the shooting will be provided during a press conference Tuesday. "We will correct some misinformation that has been circulating," the department wrote. Photos of the fight inside La Victoria Taqueria and an image of man holding a gun from an officer's bodycam were also released.




The shooting occurred at around 3:11 a.m. Sunday following a shooting at 2:44 a.m. when a man was killed near the intersection of East San Carlos and South Fourth streets, just one block away from the restaurant. According to police, officers were at the scene of the homicide when they saw people fleeing La Victoria Taqueria and received a report of a man with a gun.
San Jose police confirmed to KCBS Radio that the homicide and the officer shooting were not related.
The police department declined KCBS Radio's request for a comment regarding the shooting of the man at La Victoria Taqueria.
