Attorney: Due To Lack Of Public Hearing, FWPD Chief's Firing Is Invalid

FORT WORTH (1080 KRLD) - The attorney for ousted Fort Worth Police Chief Joel Fitzgerald is demanding a public hearing regarding his firing.

Stephen Kennedy says the city charter indicates that when the city manager seeks to terminate a director with more than six months service time, the director is entitled to a public hearing prior to a final decision.


Kennedy says the police chief is a director; and thus, Fitzgerald should have been entitled to that due process; and because he wasn't afforded it, his termination is invalid.

City Attorney Sarah Fullenwider sent a letter to Kennedy, saying that Fitzgerald failed to invoke his rights in a timely manner and that the authority to appoint and remove directors is vested solely with the city manager.
