He was convicted of murder and is serving a 25 year sentence. Thompson's wife Chauna had been charged with murder, but now prosecutors say they can't prove she committed a crime. Hernandez' cousin Melissa Hernandez says the family is sad and angry.
"We just wish there was more that was could do, but we don't want to put our family through the emotional rollercoaster we went through during Terry Thompson's trial. It's been hard."
A video of the attack shows Chauna on on the ground, next to her husband and not intervening. She was a Harris county sheriff's deputy but lost her job after the murder.
"She should have been there for my cousin, she should have helped my cousin, but she didn't do anything for him. She was helping her husband murder my cousin."
Hernandez is also upset with some other people caught on that video. While someone is videotaping, two others are yelling at him to stop the recording, claiming because Chauna Thompson is a law officer, they could go to jail.
