FORT WORTH (KRLD) - A judge says the suit against the city of Fort Worth by former police chief Joel Fitzgerald, needs to be changed.
The judge ruled the lawsuit needs to be aimed at city manager David Cooke, not the city as a whole.
Cooke fired Fitzgerald claiming a change in leadership was necessary for the police department.
Following the hearing, Fitzgerald says, "tough times don't last, tough guys do," and that he would keep on fighting.
Fitzgerald says he shouldn't have been fired, and says he was because of a whistle-blower complaint he filed.
The next hearing is November 18.
