DALLAS (1080 KRLD/NBCDFW) - A Dallas County grand jury indicted former Dallas City Councilman Kevin Felder on a felony charge Thursday after a hit and run accident earlier this year.
The single-count indictment accuses Felder of a charge of "accident involving injury." He was arrested earlier this year after the incident in South Dallas where he's accused of fleeing after hitting a teenager on a scooter.
Felder's attorney is fighting the charge and says the damage to Felder's car was caused by someone hitting it with a car door and the councilman never struck the teen.
"The teen was swerving in the road and when the councilman pulled over to avoid hitting him, the teen threw the scooter down. A collision never took place," Pete Schulte said.
A witness to the crash told police she saw the altercation between the rider and driver and that she identified Felder as the driver after having had a number of dealings with him at various community functions, including speaking at a City Council meeting as recently as last November. The witness also said she heard Felder yell at the rider, "Do you know who I am!?" before driving away from the incident.
City records show Felder called Dallas police chief Rene Hall minutes after the wreck and talked for a little more than two minutes. According to former prosecutor Toby Shook, Hall could be called in as a witness to the incident.
