Texas AG Ken Paxton appeals to Texas Supreme Court as he continues effort to block State Fair gun ban

Texas Attorney General Ken Paxton has officially filed an appeal to the Texas Supreme Court as he continues efforts to stop the State Fair of Texas gun ban. This after a special appeals panel rejected Paxton's efforts to block the law Tuesday.

Without comment, the 15th Court of Appeals denied a request by Paxton to overturn a lower court. It means for now the gun ban is on the books. The Supreme Court only has two days to get the arguments and make a decision.

The State Fair successfully argued its ban is not a firearms case but a case about private property rights. The Fair's Board wants to ban firearms at the fair after a shooting wounded three last year.

A judge, last week, refused to block the new rule from taking effect. Texas Attorney General Ken Paxton has argued the Fair is on public property, and therefore the Fair's board cannot stop citizens from lawfully carrying guns. He appealed.

But in its papers, the Fair argues as a not-for-profit it gets to set the rules.
