Dallas man says he was victim of hate crime

A Dallas man says in a lawsuit that he was the victim of a vicious attack last month that was recorded on a hotel surveillance camera and he claims the attach was hate-inspired.


James Fischer says in a complaint that he had been drinking with the man at an Uptown bar.  He said the two stopped by the Melrose Hotel on Oak Lawn Avenue to use the restroom when the man suddenly turned on him and started an attack.

Surveillance video provided by his attorney, Michael Cole, shows Fischer being repeatedly kicked in the head by a man wearing pointed-toe boots.  A Dallas Police incident report has been filed, but police have not made any calls concerning the case said Cole.

The attack was unprovoked and left Fischer with significant injuries

"I'm trying to get him set up for a traumatic brain injury examination.  His jaw is still messed up from where he got kicked.  I think the third time he caught him square on the side.  He still has trouble eating." Cole said.

Cole is asking a Dallas County civil court judge to convene a Court in Inquiry, a form of investigation that can make referrals to the Dallas County District Attorney's office.

Dallas police have not answered questions concerning the investigation.
