The family and friends of a wrongfully-convicted Dallas man will be back outside Dallas County jail today awaiting his release.
They got their hopes up yesterday after attorneys for Benjamin Spencer said he would be released yesterday. But the day-long vigil ended with Spencer still behind bars. No explanation for the delay was given.
Spencer has spent 34 in prison for a 1987 murder that even prosecutors now acknowledge he did not commit.
Nearly 14 years ago, a now-retired Dallas judge ruled Spencer had been wrongfully convicted but an appeals court overturned his decision, keeping Spencer behind bars.
But the Dallas County District Attorney's office now says Spencer did not commit the fatal carjacking that put him in prison.
