
A federal appeals court is declining to hear the death penalty case of a Dallas man who killed a convenience store clerk by setting her on fire.
Security camera video helped convict Matthew Johnson of capital murder in the May 2012 robbery and killing of 76-year-old Nancy Harris.
Ms. Harris was doused with lighter fluid and set on fire by Johnson during a robbery at a convenience store. During the trial, an emergency room nurse testified she knew Johnson's burns were life-threatening.
Following his conviction, Johnson was sentenced to death.
The Texas Court of Criminal Appeals, a US District Court judge and the 5th Circuit Court of Appeals have all allowed the conviction and sentence to stand.
