On October 7th, Eric Ortiz's girlfriend was pulling up to their home on Skillman Ave. when she saw Ortiz's truck leaving.
Puzzled, she called Ortiz who said he wasn't going anywhere, he was inside the home. They realized someone was stealing the truck.
Police say Ortiz chased the truck down, and stood in front of it, demanding the thief get out. An arrest affidavit says 33-year-old Michael Perez, instead stepped on the gas and ran Ortiz over. He later died at Texas Health Presbyterian.
Police say Perez gave several stories that didn't add up. Because the death happened during a theft, the grand jury leveled a capital murder charge.
