Relatives of a Saginaw man who was shot and killed by a frightened homeowner claims he was not a home invasion threat, but was having a medical episode.
The family of Andrew Russell, the 21-year-old shot to death by a homeowner in Saginaw, says he was disoriented after having an epileptic seizure.
A family spokesperson says that Russell had just been released from the hospital the day before he was killed and was confused, that's how he ended up banging on the door of a house on Babbling Brook Drive.
According to reports, the unidentified homeowner told police Russell wouldn't leave when he was told to, and rushed towards him, so he fired his gun and killed him.
Russell's family now wants the homeowner to face charges, but Saginaw Assistant Police Chief Russell Ragsdale says it's unlikely the young man's medical condition will come into play when the evidence is examined by a jury.
"What we have to look at is the events that unfolded at the time that the (deadly) force was used" Ragsdale told NBCDFW.
