A lawsuit against the city of Dallas over construction of a hiking trial has been tossed out.
The High Line Connector is a key to linking a 50-mile loop of hiking and biking trails that loop the city. It runs from the end of the Katy trail by the American Airlines Center to the Strand Trail on the west side of I-35.
But because of the location and complexities of traffic and lights in a high-density area it is also expensive, costing around $11.5 million.
Two companies were in the running for the project and a firm called Gadberry Construction came in with the low bid. But the city and consulting engineers weren't satisfied that Gadberry had enough experience to be in the running, so the company was booted and the contract went to the Fain Group.
Gadberry sued the city claiming it had references and should have won by virtue of the low bid. But the US 5th Circuit Court of Appeals says the city has legal protections, and its decision fell within the boundries.
The lawsuit was dismissed.
