
The union that represents Southwest Airlines pilots has won the right to continue its lawsuit against Boeing over the grounding of the 737 MAX jets.
The suit was filed after the two 737 MAX crashes in 2018 and 2019. The Southwest Airlines pilots say because the entire fleet of 737 MAX jets was grounded they were out the money that they would have earned while flying.
"The purpose behind their suit is to recover the moneys lost because of the two years those aircraft were forced to sit on the ground," said Southwest Airlines Pilots Association attorney Anthony Battista.
The suit was initially dismissed by a trial judge who barred the pilots from making any corrections to their initial suit. But now the 5th court of Appeals in Dallas has overturned the judge's dismissal and is allowing the Southwest Pilots Association to refile and push forward.
