In a highly unusual move, the Tarrant County District Attorney is asking the Texas Court of Criminal Appeals to take another look at the case of a man they sent to death row.
In a letter to the court, Tarrant County DA Sharen Wilson admits two prosecutors lied to a jury and deprived Paul Storey of a fair trial.
Storey was convicted of the 2006 murder of Putt Putt Miniature Golf Course manager Jonas Cherry in Hurst.
While Cherry's parents oppose the death penalty, the prosecutors said they supported it.
Wilson, who was not District Attorney at the time, said at the very least Storey deserves a new punishment hearing.
The options are to commute the sentence of Storey to life without parole, hold a new punishment trial, or let the sentence stand and allow Storey to be executed.
