Texas AG Paxton sues City of Dallas to stop implementation of marijuana 'legalization'

Attorney General Ken Paxton sent an official statement Thursday morning that he is suing the City of Dallas for passing Proposition R, which decriminalizes up to four ounces of marijuana.

In his statement, he declared that this city charter amendment was illegally decriminalizing marijuana-related offenses and prohibited police from enforcing Texas law.


Paxton said municipalities can't refuse to enforce Texas law concerning weed. He describes possession and distribution of marijuana as, "an illicit substance that psychologists have increasingly linked to psychosis and other negative consequences."

Furthermore, he states that the Texas Local Government Code forbids any city from adopting policies that will not fully enforce drug laws. Paxton described this proposition as, "inconsistent with the laws enacted by the Texas Legislature."

This isn't the first time Paxton has taken legal action against cities and subdivisions. In January 2024, five cities adopted marijuana decriminalization policies and Paxton sued all of them. However, some were dismissed in court despite efforts.

In response to this action, Dallas sent out a statement saying, "The city is aware of the lawsuit filed by the State of Texas regarding Proposition R and will respond to the lawsuit at the appropriate time."
