The Texas Supreme Court is weighing whether the owners of Allen Premium Outlets can be held responsible for security failures tied to the 2023 mass shooting that killed eight people and injured seven others.
Victims and their families sued Simon Property Group and other defendants, arguing the mall did not have adequate security.
The lawsuit claims the 611,000-square-foot mall had just one unarmed security guard and had received more than 3,000 police calls between 2020 and 2023. It also points to a shooting-related call at the mall just six days before the May 6, 2023, attack.
Simon is asking the court to throw out the case, arguing Texas law generally does not require property owners to protect shoppers from criminal acts committed by third parties.
The Supreme Court heard arguments Sept. 16 and has not yet ruled on whether the lawsuit can move forward.
