Capital murder indictments have been handed down against two teenagers suspected of shooting a man in the parking lot of a Dallas Costco.

On November 16, 60-year old Ali Elbanna had gone shopping and was loading merchandise in his SUV at the Costco store on Park Lane in Dallas when he was ambushed and murdered.
Dallas Police say three teenagers were behind the crime. Now 17-year old James Levels and 17-year old Janiya Miller have each been indicted on a charge of capital murder/terroristic threat.
A third teen was arrested as a juvenile and is still being prosecuted in the juvenile court system.
Dallas Police believe the four teens were involved in a cell phone robbery earlier that day and police actually used the stolen cell phones to track down the teens after the Costco shooting.
Acccording to the law, Miller and Levels do not qualify for the death penalty because of their ages.
