Trial postponed for Dallas social media influencer over allegedly deceptive fitness program

A once popular Dallas social media influencer will go on trial today, accused of scamming people who bought her online fitness program.

So-called social media personality Brittany Dawn Davis has been sued by the state of Texas over a fitness plan which billed itself a personalized health and fitness coaching service. Prosecutors claim that Davis' online fitness brand, Brittany Dawn Fitness, engaged in deceptive practices that negatively impacted customers with eating disorders.

The state says thousands of customers purchased packages ranging from $92 to $300, but according to the February 2022 lawsuit from the Texas Attorney General, Davis failed to provide individualized coaching and check-ins, as promised.

Many of the clients, some of whom had eating disorders, sought refunds from Davis and most said they were unsuccessful in their attempts.

In a since deleted video, Davis attempted to apologize on her YouTube page saying, “I am sincerely sorry for any harm I may have caused anyone.”

Davis denies accepting customers with eating disorders.

The state is seeking between $250,000 and $1 million in penalties and court fees.
