'Variety of THC' sold in Texas treading line of legality

CBD shops in Texas have been selling a lot of a substance called Delta 8.

It's stronger than CBD and weaker than marijuana. CBD products derived from hemp are legal in Texas as long as they have no more than .3 percent of Delta 9 THC, which's the psychoactive ingredient in marijuana. Only traces of closely related Delta 8 are found in cannabis.

The Delta 8 sold throughout Texas in gummies and vapes is actually lab-made from CBD.

The executive director of Texas NORML Jax Finkel says many people argue Delta 8 is legal as a hemp product because it comes from the hemp plant. "There is a memo that the Department of State Health Services put out about Delta 8 saying they do not consider it legal because of its potential intoxicative effect. And so there is a little bit of that gray area."

An attempt to ban Delta 8 failed to pass during the last legislation session.
