5th Circuit rejects Texas' challenge to $15 minimum wage order

It doesn't happen often, but the 5th Circuit federal appeals court has ruled against Texas and in favor of former President Joe Biden.

The lawsuit is over the Biden executive order requiring any contractor who does business with the feds to pay employees at least $15 an hour. Texas and two other states claim that will harm the economy.

But a three-judge panel of the appeals court ruled that's within the President's ability. UNT Dallas law professor Brian Owsley says Texas can appeal, but they also have another option.

"Someone could get President Trump on the telephone," Owsley says. "And say, 'Hey, your predecessor issued this executive order. We don't like it, would you consider resending it or entering a new executive order?'"

If it goes the latter, then the entire lawsuit would go away.
