Robert Roberson's lawyers are fighting back against the Texas Attorney General's efforts to carry out his execution.
In the latest briefing to the Texas Supreme Court lawyers for Roberson say the claims about his murder case by the Texas Attorney General's office have "devolved into a stunning smear campaign involving scurrilous misrepresentations and outright lies."
Roberson was sent to death row for the 2002 death of his daughter in a trial that relied on the shaken baby syndrome. The fight is over whether Roberson should appear before a Texas House committee that's investigating why Roberson hasn't been given a new trial under the state's Junk Science law.
The Supreme Court blocked last month's execution to honor a subpoena requiring Roberson to testify in person.
Roberson's lawyers say the attorney general is falsely stating Roberson beat his daughter to death.
