A federal appeals court has vacated the order requiring Texas to remove floating barriers in the Rio Grande River.

The 5th Circuit says the full court will hear arguments at a date in the future....but that Texas will not be forced to remove the floating devices until it makes a ruling.

A US District Court judge had initially issued an injunction to stop Texas from installing the flotation devices. A panel of the 5th Circuit upheld that judge.

No hearing date has been set.
