Whataburger facing lawsuit by employee about their retirement plan

Whataburger is trying to find a way out after a former employee threatens to sue over their retirement plan.

The Houston Chronicle reports a San Antonio man, Manuel Esquivel, accused the chain of keeping poorly performing funds in the retirement plan...instead of looking for different lucrative funds.

He claims Whataburger and its board didn't monitor their investments very well. Whataburger disagrees with Esquivel's claims and clapped back by saying he waived his right to sue them when he signed a severance agreement.

The chain is trying to get Esquivel's proposed suit thrown out.
