
Las Vegas, NV (KXNT) – The father of a Las Vegas middle school student who was seen on cell phone video taking part in a fight at the school made a court appearance on Tuesday.
A judge ruled that 39-year-old Jose Montes could be released from custody, but will wear an electronic monitoring device. He also must stay away from the boy he’s accused of assaulting.
The fight in question took place at Robison Middle School on April 12th. In the video, a group of kids can be seen surrounding two boys who were fighting, one of whom was Montes’ son. The video then clearly shows Montes stomping on one of the boys involved as that boy took a defensive position.
39-year-old Jose Montes turned himself over to CCSD Police on Monday. His attorney said on Tuesday that the boy Montes is seen attacking wasn’t even a student at the school and had been harassing Montes’ son for months.
Montes faces several charges, including child abuse/neglect, battery, and contributing to the delinquency/neglect of a minor. He’s due back in court on Thursday.
