PHILADELPHIA (KYW Newsradio) — Jerry Sandusky will be back in court next month to be resentenced after a Pennsylvania appeals court said his prison sentence was unlawfully applied. The former Penn State coach also lost his latest appeal last month.

Jerry Sandusky, 75, is scheduled to be in court Sept. 23 for a resentencing hearing as a state appeals court said the judge was wrong in the number of years he should have been sent to prison.

Sandusky was convicted seven years ago on 45 counts of sexual assault involving children and was sentenced to 30 to 60 years.

The former football coach is currently living in Laurel Highlands state prison, which serves older inmates and those with special needs.

Last month, the state Supreme Court denied Sandusky's most recent appeal, which focused on the claim his lawyer was ineffective, citing the now infamous interview with Bob Costas where Sandusky danced around over whether he was attracted to children.

Sandusky has maintained his innocence.
