DA’s office files motion to revoke bail for former officer who shot, killed Eddie Irizarry

In line with state guidelines, it is highly unusual to set bail for someone charged with murder

PHILADELPHIA (KYW Newsradio) — The Philadelphia District Attorney’s Office has filed a motion asking the court to revoke bail for former police officer Mark Dial, who is charged with first-degree murder in the shooting death of Eddie Irizarry.

In a highly unusual move, Dial was released on bail last week after a bail commissioner and Municipal Court judge ordered $500,000 bail for the 27-year-old. Only $50,000 was needed to be posted — and it was, by the police union.

In the state of Pennsylvania, judges do not set bail when someone is charged with murder because it carries an automatic life sentence.

Dial shot Irizarry six times while sitting in his car with the windows rolled up on Aug. 14. There was a knife found next to him. Neighborhood surveillance video and police body-worn camera footage of the shooting dispute the initial police narrative that Irizarry was standing outside of his car and lunged at the responding officers.

The bail commissioner, whose sole purpose is to set a defendant’s bail based on state guidelines, had said prosecutors shouldn’t “Monday morning quarterback” the decision of the police officer.

A bail hearing is scheduled for Tuesday.
